Terms of Service...
PACIFIC X HOSTING, provides internet worldwide web page hosting, shell accounts, e-mail accounts, dedicated servers, and national Internet access services.PACIFIC X HOSTING has certain legal and ethical responsibilities regarding the use of its computer network and equipment involved in these services. PACIFIC X HOSTING general policy is to act as a neutral provider of access to the global Internet. All terms of conditions stated hereof are governed by the laws under the states of (Your State), & NSW, Australia. PACIFIC X HOSTING reserves the right to suspend or cancel a customers’ access to any or all services provided byPACIFIC X HOSTING whenPACIFIC X HOSTING decides that the account has been used inappropriately.

Specific Acceptable Use Policies...
There are to be no war, xdcc eggdrops or takeover bots ran here at PACIFIC X HOSTING. You shall not run eggdrop bots on a server that doesn’t allow them. There shall be no denial of service ( DoS )attacks. If you are found using or participating in denial of service attacks you will have your account suspended immediately, pending an investigation by PACIFIC X HOSTING management.

Use of our Servers...
Web sites and shell accounts are to be used by the primary owner only. Customers running CGI or other scripts including Chat scripts not supplied as standard that use up an unreasonable amount of CPU, memory, or load average will be immediately suspended. Furthermore no customer may use more than 20% of system resources at any give time. Customers are not permitted to resell, store, or give away web hosting services off of their web site to other parties unless otherwised agreed upon in a resellers package. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads. Beastiality, "Kiddy porn", or anything including MINORS in illegal or immoral situations is forbidden and will be persued to the fullest extent of the law!

Unacceptable Conduct
The following types of conduct are grounds for immediate suspension of service pending investigation by PACIFIC X HOSTING. and may result in termination of the account(s) the investigation determines to have originated or transmitted these types of traffic. In addition, PACIFIC X HOSTING. reserves the right, where feasible, to implement technical mechanisms which block multiple postings by a PACIFIC X HOSTING. Customer as described in (a) and (b) below before such postings are forwarded: (a) Posting a single article or substantially similar articles to an excessive number of newsgroups (i.e., more than 20) or continued posting of articles which are off-topic according to the newsgroup charter, or which provoke complaints from the regular readers of the newsgroup for being inappropriate). (b) Sending unsolicited mass E-Mailings (i.e., to more than 25 users) which provoke complaints from the recipients. (c) Engaging in either (a) or (b) from a provider other than PACIFIC X HOSTING. and using an account onPACIFIC X HOSTING. as a mail drop for responses, or to draw attention to a web site housed within PACIFIC X HOSTING.'s networks. (d) Continued harassment of other individuals on the Internet after being asked to stop by those individuals and/or by PACIFIC X HOSTING.. (e) Mail bombing, i.e., sending large volumes of unsolicited E-Mail to individuals or to individual business accounts. (f) Impersonating another user or otherwise falsifying one's user name in E-Mail, Usenet postings, on Internet Relay Chat (IRC), or with any other Internet service. (This does not preclude the use of nicknames in IRC or the use of anonymous remailer services.) (g) Privacy violations: Attempts, whether successful or not, to gain access to any other system or users' private data without express consent of the user. (h) Use of IRC bots or clonebots onPACIFIC X HOSTING., whether on IRC servers controlled by PACIFIC X HOSTING. or by other parties. An IRC bot is a program which runs and is connected to an IRC server 24 hours a day, automatically performing certain actions. (i) Network unfriendly activity: Attempts to interfere with the regular workings of PACIFIC X HOSTING.'s systems or network connections or which adversely affect the ability of other people or systems to use PACIFIC X HOSTING. services or the Internet, including, but not limited to: any unauthorized attempts by a user to gain root access or access to any account not belonging to that user on this or any other PACIFIC X HOSTING. system; any use of this or any other PACIFIC X HOSTING. system as a staging ground to disable other systems. (j) Any activity which violates the laws or statutes of the United States or the Commonwealth of Australia. (k) Bestiality material such as Animalsex, Bestiality and Child Pornography are strictly forbidden and any account found serving anything of such material will be suspended immediately

Unauthorized Use of Other People's Accounts or Computers...
PACIFIC X HOSTING will strongly react to any use or attempted use of an internet account or computer without the owner's authorization. Such attempts include tricking other people into releasing their passwords, password cracking, security hole scanning, etc. Any unauthorized use of accounts or computers by a PACIFIC X HOSTING customer, whether or not the attacked account or computer belongs to KOALA HOSTING, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, according to the seriousness of the attack.Commercial Advertisements with E-mail -

Spamming...
· Unsolicited E-mail, News Bombing (SPAM) Use of the koala Hosting service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Spam complaints will be sent to the e-mail address on file. Violations of this type will result in the immediate suspension of the offending website on the koala hosting server. Failure to respond to complaints within a 24 hour timeframe will result in the koala hosting abuse staff suspending the offending website or shared hosting account by whatever means necessary. Should the account become re-activated without the express written consent of koala hostings Abuse Department, the offending website or shared hosting account will be immediately terminated, and may result in suspension / termination of the server should the site and/or client re-appear on the server. Anyone hosting websites or services on their server that support spammers or cause any of our IP space to be listed in any of the various Spam Databases will have their server immediately removed from our network. The server will not be reconnected until such time that you agree to remove any and all traces of the offending material immediately upon reconnection and agree to allow us access to the server to confirm that all material has been completely removed. Severe violations may result in immediate and permanent removal of the server from our network without notice to the customer. Any server guilty of a second violation will be immediately and permanently removed from our network without notice. Malicious intent to impede another person's use of electronic mail services or news will result in the immediate termination of the offending koala Hosting account.

Payment Policies...
All accounts are set up on a pre-pay basis. Setup fees are charged for all new accounts and major accounts changes and are non-refundable. All pricing is guaranteed for the term of pre-payment. PACIFIC X HOSTING reserves the right to change prices at any time. Payment is due on the day the account was createdl. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies PACIFIC X HOSTING to request termination of services. To help avoid additional monthly charges we you can have the option of pre-paying via Money Order for one year in advance please contact PACIFIC X HOSTING Billing to make the neccessary arrangements. All payments are made in U.S. currency.

Cancellation...
PACIFIC X HOSTING reserves the right to cancel service at any time. PACIFIC X HOSTING can not be held responsible for any lost data, revenue, or business from this act. If cancellation is caused by customers’ violation of these policies, then no refund is due. Customers can cancel service any time but no refund is due.

Domain Names...
Customers may purchase new domain names at the time of account sign-up. It is the sole responsibility of the customer to ensure that the new domain name is available for purchase. If the customer places an order for a new domain name that is not available, that client will be billed the domain name registration fee. The client must contact PACIFIC X HOSTING to purchase a new domain name, to be used instead of the pre-existing domain name.

Unlimited...
PACIFIC X HOSTING offers unlimited email accounts, mailing list, auto-responders, etc. Customers may use as many items of these features as they want, inasmuch as the resources placed on the server by that customer does not exceed 15%PACIFIC X HOSTING reserves the right to suspend customers using 15% or more of system resources at any given time.

Lawful Purposes...
PACIFIC X HOSTING reserves the right to refuse service to anyone. Customers may only use PACIFIC X HOSTING server for lawful purpose. Transmission of any material in violation of any federal, state or local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene and material protected by trade secrets .PACIFIC X HOSTING expressly forbids anyone from using PACIFIC X HOSTING servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, illegal warez, programz or any other types of hacking materials and satanic materials. The designation of any materials as such described above is left entirely to the discretion of the PACIFIC X HOSTING management. PACIFIC X HOSTING is intended for the end user only. Customers cannot sublease, subhost, or give away control of any portion of PACIFIC X HOSTING resources. Doing so could result in immediate account cancellation.

PACIFIC X HOSTING will not be responsible for any damages your business may suffer. PACIFIC X HOSTING can not be held responsible for any lost data, databases, files, or any other items hosted by our web servers. PACIFIC X HOSTING encourages all members to constantly make back-ups of your files. PACIFIC X HOSTING makes no warranties of any kind, expressed or implied for services we provide. PACIFIC X HOSTING disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by PACIFIC X HOSTING and its employees.
